A 1996 Law Governing 2025 Technology

Fast-forward nearly three decades, and AI systems process PHI at a scale and speed no human reviewer could replicate. Yet the core regulatory framework hasn’t fundamentally changed. The proposed 2025 overhaul of the HIPAA Security Rule — the first major revision in 20 years — is a step forward, but proposed regulations and enacted standards are two very different things. In the meantime, AI keeps moving.

We’re not saying this to criticize regulators. We’re saying it because healthcare organizations need to understand the gap they’re navigating, and build compliance programs that account for it proactively rather than reactively.

Three Ways AI Creates Privacy Risks HIPAA Wasn’t Designed to Address

1. The Re-identification Problem

HIPAA provides two pathways to de-identify patient data: the Safe Harbor method (removing 18 specific identifiers) and the Expert Determination method. Both were designed before anyone seriously considered what a sufficiently powerful AI could do with a dataset containing diagnosis dates, ZIP codes, ages, and clinical notes — but no names.

AI doesn’t need a name to identify a person. It needs patterns. And healthcare data is extraordinarily rich in them. Published research has demonstrated re-identification of individuals from supposedly anonymized datasets with accuracy rates that should give every compliance officer pause. Organizations need to treat de-identification not as a destination but as an ongoing risk management process — one that requires reassessment every time AI capabilities advance.

2. The Minimum Necessary Tension

HIPAA’s minimum necessary standard requires covered entities to limit PHI use to what’s genuinely needed for the intended purpose. This principle makes complete sense in traditional data governance contexts. It creates real friction in AI contexts, because AI models often perform better with more data — more breadth, more context, more historical depth.

Healthcare organizations are consistently caught between the compliance imperative to limit data access and the technical reality that AI tools work better with comprehensive data. Navigating that tension requires deliberate governance decisions, not just legal sign-off.

3. The Business Associate Agreement Gap

The BAA framework was designed for a world of relatively straightforward vendor relationships. AI has made those relationships dramatically more complex. When you deploy an AI diagnostic tool, you sign a BAA with the vendor. But what about the cloud infrastructure provider that vendor relies on? The data annotation partner that labelled the training data? The foundation model the tool is built on top of?

The American Hospital Association has called for third-party AI entities to be held to the same privacy and security standards as covered entities themselves — a recognition that the current regulatory perimeter doesn’t capture how AI data actually flows. Until that gap closes at the regulatory level, organizations need to map it at the contractual level.

Generative AI Changes Everything Again

Much of the existing HIPAA guidance around AI was developed with predictive analytics and decision-support tools in mind. Generative AI presents a fundamentally different risk profile.

When a clinician uses a generative AI tool to draft a patient summary, what happens to the PHI in that prompt? Where does it go? How long is it retained? Could it be used to improve the underlying model? The answers vary dramatically depending on the vendor, the deployment model, and the specific contractual terms in place.

The uncomfortable reality: clinicians are using consumer-grade generative AI tools with patient data right now, today, often without IT or compliance awareness. That’s not a hypothetical future risk — it’s a present compliance emergency that most organizations haven’t fully quantified.

Organizations that treat privacy as a compliance checkbox will find themselves perpetually behind. Those that treat it as a foundational design principle will build AI programs that are both safer for patients and more durable under regulatory scrutiny.

Map every AI tool in your environment. Trace data flows through every vendor relationship — including sub processors and infrastructure providers. If there’s a gap in BAA coverage, it needs to be closed before the tool goes into production.
